TERMS AND CONDITIONS

Please READ carefully, as this document outlines the Agreement pertaining to your registration and participation in any products or services (referred to as “Programs”) offered by Pure Fotografica LLC, a multi-member LLC taxed as an S-corp, doing business as Lenspreneur Academy (referred to as “Company”). By purchasing our products, you (referred to as “Client”) agree to the terms stated herein.

PROGRAM

Pure Fotografica LLC, doing business as Lenspreneur Academy, agrees to provide educational content, identified as online courses and coaching programs, designed to help photographers build and scale their businesses. Client agrees to abide by all policies and procedures outlined in this Agreement as a condition of their participation in any of our Programs.

DISCLAIMER

Client understands that neither Pure Fotografica LLC, doing business as Lenspreneur Academy, nor its founders, Yulia and Igor, are employees, agents, lawyers, doctors, managers, therapists, financial analysts, or accountants. The Programs offered are educational and informational resources for photographers and do not constitute professional advice. Client understands that participation in this Program will not diagnose, treat, or cure any disease or ailment. For such matters, Clients should consult a registered physician or relevant practitioner.

Pure Fotografica LLC, doing business as Lenspreneur Academy, makes no guarantees regarding:

Success in business, results, or sales. Coaching or mentoring in future business contracts. Procurement of publicity, social media exposure, interviews, or promotions. Introduction to the personal networks of Yulia, Igor, or their business partners.

Client understands that their relationship with the Company does not extend beyond the conclusion of this Program.

FINANCIAL OBLIGATION

Client is responsible for fulfilling all payment obligations associated with their purchase of any Programs. The Company reserves the right to pursue any outstanding payments via a Collection Agency if necessary.

METHODS OF PAYMENT

We accept Visa, Mastercard, American Express, and PayPal. Clients who choose a payment plan authorize the Company to charge their credit or debit card for the agreed-upon amount.

REFUNDS

We do not offer refunds on any of our Programs. If you choose a payment plan, you are legally required to complete all payments. The Company reserves the right to pursue recovery of any unpaid amounts through a Collection Agency.

CONDITIONAL GUARANTEE

We offer a 365-day Conditional Guarantee for certain Programs. To request consideration for the Guarantee, Clients must complete the course, attend all coaching calls (or watch replays), and submit a detailed report on the strategies applied.

Please note: All refunds are at the discretion of Pure Fotografica LLC, doing business as Lenspreneur Academy. If a Client downloads the material and immediately requests a refund, the Company reserves the right to deny the request to prevent misuse of the system.

CONFIDENTIALITY

Pure Fotografica LLC, doing business as Lenspreneur Academy, respects the privacy of its Clients and expects the same in return. Any confidential information shared by the Company, its representatives, or other participants is proprietary and belongs solely to the disclosing party. Clients agree not to disclose, reveal, or use any confidential information obtained during the Program for any purpose other than participation in the Program.

Violation of this confidentiality agreement may result in injunctive relief to prevent further breaches.

CLIENT RESPONSIBILITY

The educational products provided by Pure Fotografica LLC, doing business as Lenspreneur Academy, are intended for personal use and do not guarantee results. Client acknowledges that success is dependent on various factors, including time, effort, and personal skills. The Company makes no promises of success and assumes no responsibility for errors or omissions in the Program materials.

CONSENT TO ELECTRONIC COMMUNICATIONS

By providing your contact information during registration or through any of our forms, you expressly agree to receive email, SMS text messages, and phone calls (including pre-recorded messages or automated dialing systems) from Pure Fotografica LLC, doing business as Lenspreneur Academy, regarding programs, updates, offers, and account-related communications. Message and data rates may apply for SMS.

You may opt out of marketing messages at any time by clicking “unsubscribe” in our emails or replying STOP to any SMS message. Opting out of marketing communications does not affect your ability to receive important transactional communications about your account or participation in a program.

AUTHORIZATION AND RELEASE

By participating in the Program, Client agrees that their participation may be recorded in various forms (audio, video, images) and grants the Company the right to use these recordings for promotional purposes. The Client waives any rights to inspect, approve, or claim ownership of these recordings and releases the Company from any liability related to their use.

WEBSITE ACCESSIBILITY (ADA COMPLIANCE)

Lenspreneur Academy is committed to making its website content accessible and user-friendly for everyone, including people with disabilities. We strive to comply with the Web Content Accessibility Guidelines (WCAG) and applicable accessibility laws, such as the Americans with Disabilities Act (ADA).

MISCELLANEOUS

COOKIES AND TRACKING TECHNOLOGIES

Our website uses cookies, web beacons, and similar technologies to enhance user experience, analyze website usage, and assist in our marketing efforts. By using our website, you consent to the placement of cookies on your device in accordance with our Cookie Policy. You can modify your browser settings to control or block cookies, but doing so may affect your site experience.

Third-party tools such as Google Analytics and Facebook Pixel may also be used to track and analyze user behavior. This data is collected in aggregate and is used to improve our services.

LIMITATION OF LIABILITY

Client agrees to participate in the Program at their own risk. The Company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of its services.

NON-DISPARAGEMENT

Both Parties agree not to engage in any form of communication that could be construed as derogatory or damaging to the other Party.

INDEMNIFICATION

Client agrees to indemnify and hold harmless Pure Fotografica LLC, doing business as Lenspreneur Academy, and its affiliates from any claims arising from the use or misuse of the Program.

NO TRANSFER OF INTELLECTUAL PROPERTY

All materials provided by Pure Fotografica LLC, doing business as Lenspreneur Academy, are copyrighted and are for personal use only. Clients are not authorized to sell, distribute, or use any of the Company’s intellectual property for their business purposes.

INDEPENDENT CONTRACTOR STATUS

Nothing in this Agreement creates a partnership, joint venture, or employment relationship between the Parties. Each Party is responsible for its personnel and actions.

FORCE MAJEURE

In the event of circumstances beyond the control of either Party (such as natural disasters, war, or civil unrest), the Company’s obligations under this Agreement may be suspended without liability.

SEVERABILITY/WAIVER

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force. Failure to enforce any right under this Agreement does not constitute a waiver of that right.

ASSIGNMENT

The Client may not assign this Agreement without the express written consent of the Company.

MODIFICATION

Pure Fotografica LLC, doing business as Lenspreneur Academy, reserves the right to modify this Agreement at any time. Any modifications will be posted on the Program’s website, and Clients will be notified via email.

TERMINATION

The Company reserves the right to terminate this Agreement and remove a Client from the Program if the Client is disruptive, fails to follow Program guidelines, or violates the terms of this Agreement. No refunds will be provided, and the Client remains responsible for the full payment.

RESOLUTION OF DISPUTES

Any disputes arising from this Agreement will be resolved through binding arbitration under the rules of the American Arbitration Association. Claims must be submitted within one year of the first claim, and the arbitration process must be completed within 90 days.

EQUITABLE RELIEF

In the event of a dispute where monetary compensation is insufficient, either Party may seek equitable relief from a court of competent jurisdiction.

All notices must be delivered in writing, either by personal delivery or registered mail. Email notices are considered received as of the date of transmission. Notices should be sent to:

EARNINGS DISCLAIMER

While every effort has been made to accurately represent our Programs, there is no guarantee of specific results or earnings. Success depends on various factors unique to each Client, and the Company does not purport any Program as a “get-rich scheme.” Forward-looking statements in the Program are opinions and not guarantees of future performance.
