TERMS OF PARTICIPATION:

These Terms and Conditions ("Terms") govern your purchase of and access to Modern Headshot Method™ (the "Program"), provided by Pure Fotografica LLC, doing business as Lenspreneur Academy ("we," "us," "our"), located in Bonita Springs, Florida. By enrolling in or accessing the Program, you ("you," "student") agree to these Terms in full. If you do not agree, do not enroll.

1. ELIGIBILITY

You must be at least 18 years old to purchase or use the Program. By enrolling, you confirm that you are 18 or older and that the information you provide at checkout is accurate.

2. PROGRAM ACCESS & WHAT'S INCLUDED

Upon enrollment, you receive access to:

• The Modern Headshot Method™ course on our password-protected learning platform, including all core modules and lessons.

• The course workbook and downloadable tools, templates, and guides included with the Program.

• A private, members-only Facebook community.

• Twelve (12) monthly group coaching calls, delivered live with replays.

• The live Posing Psychology Masterclass bonus, where offered as part of a specific enrollment cohort.

You receive lifetime access to the core course recordings, but in all cases never less than 120 days from your purchase date. "Lifetime" refers to the operational lifetime of the Program and is not a guarantee of indefinite availability. Live components (coaching calls, masterclasses, guest sessions) are delivered on a schedule we set, with replays provided where possible. Bonus materials, tools, community features, and live components may be added to, changed, or discontinued at our discretion, provided the core training you purchased remains available to you. No refund is owed for a missed live call or for a bonus or feature that is changed or retired.

3. PAYMENT TERMS

The standard price of the Program is $1,299 USD. From time to time, during limited enrollment windows that we schedule, the Program is offered at a promotional price. The price and payment options available to you are those stated at checkout at the time of your purchase.

Current launch cohort offer:

- One payment of $999 USD, or

- Three (3) monthly payments of $379 USD, with the first payment due at checkout and the remaining payments charged automatically every 30 days thereafter.

Promotional pricing and any associated bonuses are available only during the stated enrollment window. When that window closes, the Program returns to its standard price of $1,299 USD, and promotional bonuses are no longer included. All prices are in US dollars and are exclusive of any applicable taxes, which are your responsibility where required.

4. PAYMENTS/FAILED PAYMENTS

If you enroll on a payment plan, you are committing to the full purchase price of the Program, not to a single payment. You authorize us to automatically charge your payment method on each scheduled date until the balance is paid in full, and it is your responsibility to keep a valid payment method on file.

If any scheduled payment fails or is not completed, we will pause your access to the Program and all Lenspreneur Academy programs until your account is brought current, and we will continue attempting to charge your payment method on file. If your balance remains unpaid for 14 days after a failed payment, the remaining balance becomes due, and we may refer it to collections or pursue any other remedies available to us. A paused or unpaid account does not reduce or cancel the amount you owe and does not entitle you to a refund of payments already made.

Before access is revoked for non-payment or for any dispute, we document your activity and progress inside the course, including lessons viewed, materials downloaded, and assignments completed, and we may submit this record as evidence in any dispute. Access to this Program is reserved for students in good standing whose payments are current.

5. REFUNDS: ALL SALES FINAL EXCEPT THE GUARANTEE

Except as expressly provided in the 90-Day Do-the-Work Guarantee in Section 6, all payments for the Program are final and non-refundable. Purchasing the Program does not entitle you to a refund for change of mind, lack of time, failure to use the materials, or general dissatisfaction that does not meet the guarantee requirements.

6. 90-DAY DO-THE-WORK GUARANTEE

We are happy to honor this guarantee for students who genuinely engage with the training and implement the work. To be fair to all our students and to protect this Program from abuse, we require a few simple proofs that you have done your part.
To qualify for the guarantee, you must, between day 45 and day 90 of your purchase date, submit all of the following:

a) Complete the core training and assignments.

   - Watch all core modules (1 through 6).

   - Complete the workbook assignments for each module.

   - Submit photos or PDFs of your completed workbook pages.

   - Include at least 5 to 10 sentences explaining why Modern Headshot Method™ was not a good fit for you.

b) Build your Headshot Offer Plan.

   - Submit your completed two-page headshot offer plan (offer, pricing, ideal client, key message, basic workflow).

   - Briefly explain why having this in place did not improve your clarity or confidence.

c) Show that you marketed the offer.

   - Submit a link or PDF of your headshot offer page or website section, and

   - Screenshots of at least one email campaign and three social posts or direct outreach messages where you promoted the offer to real people.

   - Include send dates so it is clear this was done within the window.

d) Show that you tried to book or run a Modern Headshot Day.

   You do not have to prove big sales, but you do need to show a real attempt. Either:

   - A screenshot of a scheduled Modern Headshot Day on your calendar (even if it did not fill), plus any booking records or inquiry messages you received for it; or

   - Screenshots of at least 10 individual outreach messages or conversations where you offered the Modern Headshot Day to real potential clients.

   Then explain the outcome and why you felt the system did not work for you.

How to request: Email help@lenspreneuracademy.com between day 45 and day 90 of your purchase date, and include all of the proofs above. Because building this system takes real work and time, we do not review refund requests before day 45. The first few weeks are not enough to fairly put the work in or to judge whether it worked for you.

Requests submitted before day 45, after day 90, or without complete documentation will not be considered.

This is not a change-your-mind refund; it is a guarantee for students who do the work and still do not see a fit.

7. CHARGEBACKS & PAYMENT DISPUTES

By enrolling, you acknowledge that Modern Headshot Method™ is a digital program delivered immediately upon purchase, and that you are granted access to valuable proprietary materials the moment you join. You agree that your sole remedy for any dissatisfaction is the 90-Day Do-the-Work Guarantee described in Section 6.

You agree not to initiate a chargeback, payment dispute, or claim of fraud with your bank or card provider without first completing the guarantee process and allowing us to respond. Initiating a chargeback while retaining access to the Program materials is a breach of these Terms, because you would be keeping the Program and its proprietary tools while reversing payment.

In the event of a dispute, we reserve the right to submit these Terms, your purchase record, your access and completion logs, and all related correspondence to your bank or card provider as evidence. We also reserve the right to revoke your access to all Lenspreneur Academy programs and to pursue any balance owed.

8. INTELLECTUAL PROPERTY & LICENSE

All content within the Program, including videos, lessons, workbooks, templates, scripts, guides, lookbooks, and community materials, is the intellectual property of Pure Fotografica LLC DBA Lenspreneur Academy and is protected by copyright and other laws.

Upon enrollment, you are granted a single-use, non-exclusive, non-transferable, revocable license to access and use the Program materials for your own personal and business use as a photographer. You may use the included templates, scripts, and client-facing tools within your own photography business.

You may not copy, modify, distribute, publish, share login credentials, resell, license, reverse engineer, repackage, or otherwise exploit the Program or its materials, in whole or in part, for any purpose outside your own photography business. Sharing, reselling, or redistributing the Program or its materials is a violation of these Terms and of applicable copyright law.

9. STUDENT CONTENT & TESTIMONIAL LICENSE

We frequently invite students to share their results, wins, and feedback, and we feature them in our marketing. By submitting feedback, testimonials, reviews, or results to us, by posting wins, images, or comments in our community, or by tagging us in your work, you grant Pure Fotografica LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content, including your name, likeness, images, and statements, in our marketing and promotional materials across any channel, without further compensation. You may ask us in writing at help@lenspreneuracademy.com to remove your content from future marketing at any time.

10. CODE OF CONDUCT

Our private community is a supportive, professional space for photographers. You agree to engage respectfully and not to spam, harass, self-promote outside designated areas, or share other students' content or wins without permission. We reserve the right to remove any student from the community, without refund, for conduct that harms the community or violates these Terms.

11. NO GUARANTEE OF RESULTS / EARNINGS DISCLAIMER

Modern Headshot Method™ teaches the systems, strategies, and workflows we use in our own studio. We make no guarantee of any specific income, revenue, sales, bookings, or business result. Any examples of earnings or results, whether ours or our students', are illustrations of what is possible, not promises or averages. Your results depend on your effort, your market, your existing skills, your pricing, your follow-through, and many factors outside our control. It is entirely possible to complete the Program and earn nothing. All content is provided "as is" for educational purposes and does not constitute legal, financial, tax, or business advice.

12. TESTIMONIALS DISCLAIMER

The testimonials and results shared on our website and in our marketing are real and were shared by actual students, often at our request. They reflect those individuals' own experiences and are not typical. They are not a guarantee or representation that you or anyone else will achieve the same or similar results.

The Company respects the privacy of its clients and will not disclose any information you provide except as set forth in this Agreement. As a condition of participating in the Program, you agree to respect the privacy of other Program participants and the Company’s confidential information.

You shall not share any information provided by other participants outside of the Program unless you receive express written permission from the participant. Similarly, the content of the Program contains the Company’s proprietary methods, processes, templates, and other information. You agree not to share the information provided to you with anyone other than the Company, its owners and employees, and fellow participants.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pure Fotografica LLC and its owners, employees, and contractors from any claims, damages, losses, or expenses, including reasonable attorney's fees, arising from your use of the Program or its materials in your own business, including your use of any templates, scripts, contracts, pricing, or client-facing documents we provide. The Program materials are educational examples. You are responsible for ensuring they are appropriate and legally compliant for your business and your jurisdiction.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pure Fotografica LLC and its owners, employees, and contractors are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Program. Our total liability for any claim relating to the Program is limited to the amount you paid for it.

15. PRIVACY

We collect and handle your personal information in accordance with our Privacy Policy, available at [LINK]. By enrolling, you consent to the collection and use of your information as described there.

16. FORCE MAJEURE

We are not liable for any failure or delay in delivering live or scheduled components of the Program due to circumstances beyond our reasonable control, including illness, emergencies, technical failures, or acts of God. In such cases, we will make reasonable efforts to reschedule or to provide a recording.

17. RESOLUTION OF DISPUTES

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. To the fullest extent permitted by law, you waive any claims against Pure Fotografica LLC and its owners, employees, and contractors arising from or relating to the Program, except as expressly provided in these Terms. Any dispute that cannot be resolved directly between us shall be resolved exclusively in the state or federal courts located nearest to Bonita Springs, Florida, and you consent to the jurisdiction of those courts.

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with any documents expressly referenced here, constitute the entire agreement between you and us regarding the Program and supersede any prior agreements or understandings.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version in effect at the time of your purchase governs your enrollment. Continued use of the Program after an update constitutes acceptance of the revised Terms.

21. ACCEPTANCE

By enrolling in or accessing Modern Headshot Method™, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
